Abstract
Deux employés, non syndiqués mais membres d'une unité de négociation en grève, se sont vus refuser le droit de travailler pendant la grève, leur employeur ayant préféré avoir recours à des briseurs de grève. Dans leur plainte, ils ont allégué que ce refus de leur employeur constituait une pratique déloyale aux termes du sous alinéa 94(3)a)(vi) du Code. Le Conseil a décidé que l'employeur n 'avait pas commis une pratique déloyale puisque le Code ne confère pas aux employés visés le droit de continuer à exercer leurs fonctions au cours d'une grève. Le Cotiseil a aussi décidé que le sous-alinéa 94(3)a)(vi) ne violait pas les articles 2 et 15 de la Charte canadienne des droits et libertés.
