L’association entre conscience et serment allait de soi au XVIIe siècle. Le fait de jurer impliquait la conscience dans sa capacité religieuse autant que morale, puisqu’on gageait la confiance sur le salut éternel. Certaines postures radicales ont montré la vulnérabilité du serment dès lors que des mutations dans la manière de concevoir la conscience elle-même conduisaient à ne pas « jouer le jeu » auquel il invitait. C’est le cas du plus connu des groupes refusant de jurer pour des questions de principe, les Quakers. Cette contribution propose une analyse de leurs motivations théologiques et de leurs stratégies argumentatives et judiciaires, elles-mêmes profondément en prise avec les enjeux politiques et sociaux de l’Angleterre du XVIIe siècle. Le cas des Quakers est d’autant plus intéressant qu’ils ont su développer un ensemble de stratégies légales afin de contourner les sanctions qui leur étaient infligées, aboutissant à terme à une évolution de la législation et de la pratique du serment elle-même.
