Abstract
En France, la décentralisation des compétences en matière fluviale, entamée dès la fin des années 1980, ne donnait pas totale satisfaction. Aussi, une loi du 30 juillet 2003 est venue approfondir la décentralisation en permettant le transfert de la propriété du domaine public fluvial au profit de collectivités ou groupements de collectivités qui en feraient la demande. Cependant, si le transfert de propriété répond à la plupart des lacunes observées avec la première vague décentralisatrice, le dispositif mis en œuvre demeure profondément critiquable, notamment parce qu’il introduit une « balkanisation » du domaine public fluvial, en contradiction avec la cohérence hydraulique.
