Reprenant une distinction élaborée par le professeur Bruno Leoni entre le « droit des juristes » et la « législation », l'auteur tente de démontrer que l’utilisation par les sociétés occidentales de cette dernière comme mécanisme privilégié d'adaptation du droit aux nouvelles réalités nous enferme dans un cercle vicieux qui entraîne des effets néfastes, tels que l'instabilité chronique du droit et son inaccessibilité.
