Abstract
Soumis en tant que juge ordinaire, au Conseil constitutionnel et en tant que juge du respect des traités internationaux, à la Cour Européenne des Droits de l’Homme, le juge judiciaire français fut plongé au cœur de la controverse des validations législatives : dans un arrêt Zielinski du 28 octobre 1999, la Cour européenne sanctionna la France pour une validation législative pourtant jugée conforme à la Constitution française, que le juge judiciaire aurait du écarter. La Cour européenne incite donc celui-ci à infléchir son obédience envers le Conseil constitutionnel. Si la potentialité de la sanction Zielinski est considérable pour l’équilibre institutionnel et normatif de la Ve République française, la Cour de cassation fait preuve d’une pratique mesurée et constructive : elle choisit d’exercer la compétence conventionnelle non pas au service de la Convention européenne de 1950 mais dans le respect et pour la promotion du système juridique dont elle procède directement.
