Abstract
Un épisode du règne de Henri II apparaît dans la République de Bodin (1576 et 1586) comme le symbole d’une justice pervertie et « nocturne », c’est-à-dire soustraite aux garanties d’une pratique exigeant des preuves « plus claires que le jour ». Le rapport entre politique et magistrature, examiné dans sa dimension pré-moderne, met au premier plan le problème du lien entre norme morale et norme juridique. La critique de la conception légaliste du droit, au-delà des lieux communs d’une littérature centrée sur le « principe de légalité » comme fondement du constitutionnalisme moderne, montre que le problème se présente à nouveau aujourd’hui de façon cruciale dans la crise des démocraties modernes et le conflit actuel entre politique et magistrature.
