L'adoption, l'Église et l'État : les origines tumultueuses d'une institution légale

Abstract
L'adoption contemporaine connaît une remise en question dans la plupart des pays occidentaux. Outil privilégié de protection de la jeunesse ou mécanisme de substitution de la filiation, penchant entre ces deux pôles, l'adoption a connu des changements importants dans un contexte de dénatalité et d'internationalisation des rapports sociaux. À l'heure où certains s'interrogent sur l'essence même de cette institution, le présent article remonte aux origines de l'adoption légale au Québec afin de mettre en lumière les débats idéologiques qui ont, à l'époque, opposé l'Église et l'État sur la question. Notre étude illustre, une fois de plus, que ce sont généralement les enfants qui font les frais des querelles d'adultes et elle tend, incidemment, à dégager de cette analyse historique certains éléments de réflexion utiles aux débats sur l'avenir de l'adoption.
