Abstract
Le principe de mutualité est régulièrement invoqué en doctrine et en jurisprudence pour justifier les obligations des parties au contrat d’assurance. Or, la mutualité s’avère désormais quasi inexistante en matière d’assurance, et ce, bien que la notion soit plurielle. C’est en général à un spectre de mutualité que renvoient les juristes. En ce sens, et afin de favoriser une meilleure compréhension du preneur quant à la teneur juridique de son contrat, la base normative des obligations des parties devrait être redéfinie dans un sens moins chargé au plan idéologique. Ceci permettrait de refléter davantage le caractère technique, économique et actuariel du service qu’offrent les assureurs, établissant ainsi des balises obligationnelles plus précises.
