Abstract
Le principe de précaution fait aujourd'hui l'objet de vives querelles au sein de la doctrine. En ce qui concerne la jurisprudence, on essaye encore de lui trouver un sens et une véritable signification juridique. Néanmoins, il est aisé de reconnaître que ce principe est en émergence, tout particulièrement sur le plan mondial où les traités internationaux, surtout dans le domaine de l'environnement, en font un aspect fondamental de leur corpus juridique. Tel est le cas du Protocole international sur la prévention des risques biotechnologiques. Le principe de précaution y est intégré. Cependant, son acceptation n 'a pas été facile, même s'il est indéniable que sa simple prise en considération dans ce nouvel instrument international est porteuse des germes d'éventuels conflits de normes entre le commerce international et la protection de l'environnement.
