Abstract
Terrain d’élection de la théorie de la compliance, les procédures de contrôle du respect des obligations étatiques des accords environnementaux multilatéraux (AEM) auraient pu constituer un cadre de réception et d’application du principe des responsabilités communes mais différenciées (PRCMD). Toutefois, les références à ce principe d’élaboration d’obligations différenciées s’avèrent impropres à un mécanisme de contrôle de l’application des obligations. Les références au PRCMD sont alors exceptionnellement explicites ou seulement implicites. Reconnaître actuellement l’application du PRCMD dans le contrôle du non-respect fait courir le risque d’une dénaturation de ce principe émergent.
