Abstract
La déontologie par sa juridicité mais aussi la proximité qu'elle suppose avec la morale paraît être le moyen idéal pour que le droit se rapproche de la justice. Cependant, la puissance de la déontologie en matière financière s'explique aussi en ce que la confiance qu'elle exige et qu'elle engendre garantit l'efficacité du système : l'utilitarisme plus que la vertu fonde cette progression. Dès lors, la déontologie se présente comme une régulation alternative par rapport à celle du droit. Toutefois, l'efficacité de la déontologie suppose que ses règles régissent un cercle clos de professionnels, ce que la mondialisation et Internet attaquent. Il faut donc en revenir au droit, par le recours à un droit vertueux, au sens systémique du terme, à savoir cohérent et constant, donnant une règle de droit autour de laquelle les anticipations des acteurs peuvent s'articuler.
