Abstract
C’est d’un trouble de voisinage en quête d’identité qu’il est ici question : situé aux confins du droit des biens et du droit des obligations, du droit réel et du droit personnel, son fondement demeure nébuleux. La problématique émerge d’elle-même : quelle est la place dévolue au trouble de voisinage dans l’espace normatif québécois ? L’interprétation historique, exégétique et jurisprudentielle de l’article 976 du Code civil du Québec permet de poser l’hypothèse voulant que le trouble de voisinage soit désormais appelé à jouer un véritable rôle de régulation sociale. S’il naît du droit civil, son extension au domaine de la protection de l’environnement par le truchement des recours collectifs catalyse le potentiel qu’il porte en lui et qui consiste à assurer la coexistence pacifique entre voisins.
