Depuis ses débuts au Canada et dans le monde occidental, il y a maintenant une trentaine d’années, la justice restaurative est apparue comme une nouvelle façon de faire justice, remettant en question la réaction pénale au crime. Au cours des années 1990, de multiples programmes identifiés à la mouvance réparatrice se sont développés au Canada, que ce soit dans le domaine communautaire ou au sein même d’institutions caractérisées essentiellement par leur approche pénale, comme c’est le cas pour les services correctionnels fédéraux. L’introduction de mesures plus réparatrices au sein d’institutions à vocation essentiellement pénale n’est pas sans susciter des interrogations portant justement sur les rapports et la possible coexistence entre les deux modèles de justice. Quels accommodements sont pris de la part des deux modèles mis en présence? Faut-il parler d’hybridation des modèles ou d’appropriation de l’un par rapport à l’autre? En d’autres termes, ce processus contribue-t-il à transformer et à déformer les principes de justice restaurative? C’est à cette question des rapports entre justice restaurative et justice pénale que nous nous intéresserons dans le cadre de cet article, en utilisant plus précisément à l’exemple concret d’un programme « novateur » de justice réparatrice intégré au système pénal et mis en place dans la ville d’Ottawa, « le projet de justice coopérative ». Ce faisant, nous analyserons les résultats de ce « mélange » pour essayer en finale de répondre à la question suivante : « comment assurer la viabilité et l’efficacité d’une alternative au pénal au sein du pénal lui-même »?
