Les maladies neurodégénératives, dont la maladie d’Alzheimer, sont de plus en plus fréquemment l’objet de recherches et d’expérimentations nouvelles. La durée requise de participation à certains projets de recherche atteint parfois quelques années. Souvent, la personne atteinte amorce sa participation à l’expérimentation alors qu’elle est apte, car elle se trouve à un stade précoce de sa maladie. Or, l’inévitable finit par se produire lorsque la dégradation progressive des cellules du cerveau a diminué considérablement les facultés mentales de la personne, au point de la rendre inapte. La question se pose alors de savoir si le sujet devenu inapte peut être maintenu dans l’expérimentation ou s’il doit en être retiré. On peut juger que le Code civil du Québec semble trop rigide dans sa protection des personnes inaptes, et que les dispositions de son article 21, par leur caractère pointilleux, pourraient empêcher la réalisation de projets de recherche souhaitables. Nous proposons ici une approche nouvelle, qui pourrait faciliter la recherche auprès des personnes atteintes de maladie neurodégénérative. Cette approche prévoit également de respecter intégralement les droits des sujets, et ne nécessite aucune modification du Code civil. Dans l’éventualité d’une spécificité du cadre législatif canadien et québécois en termes d’expérimentation, il a semblé nécessaire de requérir l’avis d’un expert français en matière d’éthique médicale: le professeur Claude Huriet, ancien membre du Comité consultatif national d’éthique, a donc, à cet effet, rédigé un commentaire critique du texte de Michel T.Giroux.
