Abstract
Les codes québécois et américain, peuvent-ils avoir dans les provinces canadiennes de common law un effet conjugué, et ce, tant sur le fond que la forme ? C’est ce que l’auteure développe dans son article. Dans la première partie, il est question premièrement de la démarche méthodologique utilisée dans les États de tradition de common law en vue de codifier le droit et de l’historique de la codification en Angleterre, aux États-Unis et au Canada. Dans la seconde partie, l’influence américaine et québécoise sur les provinces canadiennes de common law fait l’objet d’une analyse. L’auteure conclut que tout est aujourd’hui en place pour que certaines codifications américaines ainsi que le Code civil du Québec puissent avoir un effet conjugué sur le droit des provinces canadiennes de common law avec, cependant, une réserve au sujet de la forme. Dans les provinces canadiennes de tradition de common law, il y a lieu de croire que le recours à des lois codificatrices pourra continuer à se limiter à des champs circonscrits, malgré l’élargissement éventuel de ces champs au fur et à mesure que les codifications antérieures seront jugées probantes.
