Abstract
L’équité dans l’office du juge est un principe modérateur du droit objectif selon lequel le juge apporte des atténuations ou des modifications au droit, à la loi, en considération de circonstances particulières, afin de donner à chacune des parties un traitement juste, égalitaire et raisonnable. En Chine contemporaine, la fragilité du droit chinois et l’activisme judiciaire permettent une grande liberté à cet égard. Ainsi, la Cour suprême populaire a un pouvoir « réglementaire » pour édicter de nombreuses circulaires interprétatives ; récemment, elle a conçu un autre moyen pour introduire l’équité par établissement d’un système d’arrêts directifs, système qui constitue pour ainsi dire la jurisprudence « chinoise ». Quant aux juges, fréquemment aux prises avec d’autres pouvoirs et les justiciables, ils introduisent délicatement l’équité dans leur pouvoir modérateur afin de bien jouer un rôle de coordonnateur dans la communauté.
