Abstract
La présente étude propose une interrogation sur la culture juridique chinoise. L'auteur, en analysant la pensée de l'École des légistes, et en comparant cette école avec le confucianisme, tente de saisir certains traits significatifs pour comprendre cette culture juridique. Après un rappel historique, il analyse la conception de loi selon le légisme : d'abord en tant qu'idée, ensuite comme technique de pouvoir, puis sous le rapport de l'efficacité, et enfin en tant que système. L'auteur caractérise cette conception de droit comme entièrement bureaucratique. Il souligne dans sa conclusion comment cette tradition n'a jamais su enraciner une conception de l'État de droit et des libertés juridiques.
