Abstract
La domestication de la pensée juridique québécoise Cet article examine l'histoire de la culture juridique québécoise depuis les années 1840 jusqu'à aujourd'hui. la transformation de ses moyens et de ses rapports de communication. On y montre que la culture des années 1840 était encore à prédominance orale, et que la tradition orale dans l'organisation du savoir, à savoir la rhétorique et le débat, persista, malgré la codification des lois du Bas-Canada en 1866. jusqu'au XX" siècle. Durant les années 1920. par contre, on insista plutôt sur l'analyse et l'exégèse, la logique de l'écriture (et de la codification) ayant finalement été intériorisée par le corps judiciaire. Cette intériorisation eut un impact énorme sur le contenu du système juridique, comme le suggère l'ouvrage de J. Goody.The Domestication of the Savage Mind.
