Abstract
The conditional sentence is the exemption from punishment under specific conditions, so according to its severity, it cannot and should not be compared with the real measures of punishment. Elements of compulsion inherent in suspended sentence, lie in the possibility of imposing a court on a person convicted of reference (h. article 4. 73 of the CRIMINAL code of the RUSSIAN federation) and in the implementation of the it control during the probationary period (art. 188 OF THE PENAL CODE). Assignment of responsibilities is a right and not an obligation of the court. According to this criterion, we can distinguish two types of conditional sentence with the imposition of duties and without such disqualification. Scholars and practitioners unanimously recommends that impose on the convicted conditionally statutory duties, however, the courts often ignore the law. The survey identified about a quarter of prisoners (26, 3%), with sentences which contained no mention of any assigned to them responsibilities, and not because of the fact that they did not need much attention paid to them by the supervisory authority.
