Abstract
Cet article présente l’évolution de deux discours dominants (le médical et le religieux) qui ont interféré avec le système de droit pénal dans sa conceptualisation et sa gestion des mœurs homoérotiques au Québec de la création du premier code criminel canadien en 1892 à l’adoption du projet de loi Omnibus en 1969. L’analyse des interactions entre ces formations discursives et le système de droit pénal montre que même si droit et religion, droit et « science » s’opposent à l’occasion pour imposer leur compréhension du « phénomène homosexuel », ils ne s’excluent pas toujours mutuellement. Au contraire, ils se renforcent souvent les uns les autres.
