Abstract
L'article présente les traits essentiels du droit du travail polonais actuel et propose des orientations quant à sa réforme en cours. Le présent Code du travail, adopté en 1974, véhicule plusieurs institutions fondamentales façonnées durant l'entre-deux-guerres et adaptées au contexte de la Pologne populaire. Il s'agit essentiellement du droit individuel du travail, d'application relativement générale. Le rôle prédominant de la loi, par rapport aux conventions collectives, correspond à une période de centralisme. L'examen du champ d'application et du contenu du Code conduit, au regard de l'évolution de la société polonaise et du droit du travail contemporain, à un constat d'insatisfaction à divers égards : nécessité, en particulier, dans une perspective davantage pluraliste, d'accentuer le rôle des conventions collectives et des accords nationaux. Le Code du travail devrait formuler les principes fondamentaux du droit du travail, régir également les rapports collectifs, ce qui entraîne la définition du régime syndical ; il devrait être d'application encore plus générale et intégrer notamment les dispositions légales relatives à la participation du personnel. Le Code devrait aussi comprendre les dispositions relatives au placement, à l'inspection du travail et définir plus adéquatement les droits du travailleur en cas de résiliation de son contrat de travail... Il doit, en somme, s'agir d'un acte couvrant en principe tout le droit du travail.
