Abstract
Au Portugal, à la fin du xixe siècle, les patrimoines fonciers jusqu’alors indivisibles (les majorats) sont contraints de s’ajuster aux exigences nouvelles du partage égalitaire. L’entrée en vigueur de cette législation (1867) implique la répartition des biens entre les membres d’une même fratrie, hommes comme femmes, et une réorganisation complète de la gestion du patrimoine et de la place des germains dans la famille. Les droits d’eau attenants aux terres, jusqu’alors en la possession de l’aîné des garçons, sont désormais distribués et partagés entre tous les enfants. À partir de l’exemple d’une transmission des biens suivie sur quatorze générations, articulant deux systèmes de dévolution entre eux, le système préciputaire et le système égalitaire, il s’agira de montrer comment et pourquoi les droits d’eau sont aujourd’hui entre les mains des femmes dans la région nord-ouest du Portugal.
