Abstract
Toutes les sociétés construisent un discours destiné à donner un sens à la réalité concrète de la reproduction humaine. En Occident, l’institution de la filiation est au coeur de ce discours, marqué par des racines romano-canoniques. Relativement immuable et plutôt fidèle à ses origines pendant plusieurs décennies, le droit de la filiation a subi d’énormes bouleversements depuis quelques années, particulièrement au Québec. Or, la littérature juridique qui s’est intéressée à ce phénomène a surtout appuyé ses analyses sur des fondements positivistes sans se pencher sur la nature et le rôle de la filiation dans la vaste entreprise de la « subjectivation » humaine. L’objet du présent article est donc d’apporter un éclairage nouveau à cette branche du droit, en la considérant sous un angle particulier et inusité, celui de l’approche psychanalytique du droit. D’abord, l’auteure expose cette approche telle qu’elle a été élaborée par le juriste et psychanalyste français Pierre Legendre. Ensuite, elle crée un rapprochement entre cette approche et le droit de la filiation, plus particulièrement dans son aspect de codification.
