Il n’est pas simple de tracer le portrait des conditions de détention des femmes dans un pays où le régime carcéral relève des deux niveaux de gouvernement et de treize juridictions locales ; à un premier niveau, tout extérieur, on peut rendre compte de la structure et des aspects matériels des établissements carcéraux, ce à quoi s’emploie l’auteure de cet article dans un premier temps. À ce niveau un clivage s’est dessiné depuis 1995, quand l’établissement fédéral a été transformé en plusieurs institutions régionales, rendant possible un régime de vie plus « normal » et plus « responsable » ; en même temps, on assistait à un certain enrichissement des programmes de vie dans les prisons. Mais les structures extérieures et les conditions matérielles ne résument pas toute l’expérience de la détention ; celle-ci est ressentie par des personnes réelles, d’abord dans la durée de la sentence, puis dans la sévérité du régime, lequel conditionne les possibilités de relations avec les proches à l’extérieur. Or, sur les personnes en cause, sur la durée de leur peine et son niveau de sécurité, le tableau est impossible à dresser, car les statistiques correctionnelles canadiennes parlent de personnes sans sexe et sans identité ethnique ou culturelle. Cette situation est problématique pour les chercheurs, les féministes, les dirigeants des Premières Nations ; la situation devrait également préoccuper les législateurs et les administrateurs correctionnels. Comment, dans ces conditions, penser l’incarcération des femmes ?
