Abstract
Dans l’article qui suit, l’auteur définit ce que pourrait être le domaine de recherche « droit et pédagogie » en faisant l’inventaire des publications pouvant s’y intégrer et servir de fondements. Trois grandes approches orientent la démarche d’exploration de ce domaine de recherche : le droit de la pédagogie, le droit comme pédagogie et le droit dans la pédagogie. Chacune permet d’explorer une autre dimension de la relation qu’entretiennent, ou pourraient entretenir, la justice et l’école, deux institutions étatiques chargées, entre autres, de réguler les comportements des individus. L’article se termine par une analyse critique du livre de Violaine Lemay, Évaluation scolaire et justice sociale , seul ouvrage québécois à se réclamer ouvertement du droit et de la pédagogie.
