Les dernières années ont été riches en scandales politiques de toutes sortes. Pour tenter de résorber la situation et de corriger le tir, le gouvernement du Québec a fait adopter une loi à l’Assemblée nationale pour régir la nomination d’un commissaire à l’éthique et l’adoption d’un code d’éthique pour nos élus. Pour plusieurs, il y a là, plus qu’une réponse politique, un réel souci de régler le problème en encadrant mieux les comportements de nos élus, en régulant leur travail de même que celui des membres de l’administration publique et en établissant des normes pour ce travail. Pourtant, je ne crois pas que cela suffira puisque l’on ne s’attaque pas au véritable problème, qui est celui de la crise que traversent le droit et nos institutions. Le recours à l’éthique plutôt qu’au droit s’impose, non pas pour corriger et réguler les comportements, mais pour redonner son plein sens au travail des élus. Ce recours à l’éthique doit se faire en complémentarité avec le droit pour aider les élus à mieux cerner les risques éthiques qu’ils courent et pour doter nos institutions d’infrastructures éthiques.
