Abstract
La garde partagée de l’enfant après la séparation ou le divorce de ses parents n’a cessé de susciter interrogations et débats au cours des dernières décennies. Ni interdite ni implicitement autorisée par nos lois, cette formule de garde, qui demeure minoritaire, représente pourtant pour plusieurs un idéal. Le présent texte expose les résultats de divers volets de nos recherches récentes sur ce sujet. Des juges ont été interviewés, des dossiers judiciaires examinés et des jugements analysés. De plus, une étude sur le terrain a été effectuée auprès de parents pour qui cette formule de garde a trouvé application soit à la suite d’une entente entérinée par la Cour, soit à la suite d’une décision judiciaire imposée. En ressortent certains constats et tendances qui, loin d’épuiser le débat, y apportent néanmoins quelques touches inédites.
