Abstract
L'Avant-projet sur la prescription frappe d'abord par la réduction spectaculaire qu'il propose des délais de droit commun de prescription acquisitive et extinctive. Dans son ensemble, il s'inscrit dans le contexte du droit actuel dont il réaménage, clarifie et simplifie les dispositions. Tel n'est pas le cas, cependant, des articles devant régir l'usucapion des droits réels immobiliers. Leur source d'inspiration est étrangère à la conception actuelle de la matière. Les articles 3096 à 3098 posent la question de leur compatibilité, non seulement avec le reste de l'Avant-projet, mais aussi avec les règles relatives à la possession, la vente et la publicité foncière contenues dans les autres projets de lois sur le Code civil du Québec.
