Abstract
La laïcité n'est pas un idéal qu'il s'agirait simplement de mettre graduellement en pratique ; ce n'est pas un concept abstrait, absolu, elle est de l'ordre concret de l'accommodement raisonnable et de l'ajustement contextuel. Tous les États occidentaux ont adopté des solutions fort nuancées qui varient selon des contingences historiques, sociopolitiques, démographiques. Au Québec, le rapport Bouchard-Taylor et le rapport Proulx ont traité de laïcité dans une perspective « de laïcité ouverte », ce que ne reconnaissent pas la Commission et le Tribunal des droits de la personne. En Europe, la Cour européenne des droits de l’homme a accepté que l’Italie maintienne le crucifix au mur des écoles publiques ; le Conseil d’État français (tribunal suprême) a validé les actions des pouvoirs publics en faveur des confessions religieuses musulmanes ou chrétiennes au nom des traditions culturelles ou de l’intérêt public local.
