Abstract
La primauté du droit, maintenant expressément mentionnée dans le préambule de la Charte canadienne des droits et libertés, a inspiré à de nombreuses reprises la Cour suprême du Canada depuis une dizaine d'années. Cependant, il manque encore en droit canadien une théorie générale qui définirait la portée concrète de ce concept dans l'ordre juridique. L'objet du présent texte est de tenter de cerner la nature même de la primauté du droit et d'analyser, en fonction des trois idées suivantes, l'utilisation que la Cour suprême du Canada a faite de ce concept: la primauté du droit rend nécessaire l'existence d'un ordre juridique, fondé sur des règles de droit; il est nécessaire que les personnes et entités évoluant dans la société soient assujetties à cet ordre juridique ; les justiciables doivent disposer de recours permettant de mettre en œuvre les règles de droit lorsque survient un conflit.
