Abstract
La production et l’application des normes juridiques ont subi de multiples transformations qui peuvent être lues à la lumière de l’émergence de nouveaux modes de gouvernance étatique. Ces mutations ont fait constater à plusieurs théoriciens du droit que l’image de la pyramide associée à l’architecture de la théorie générale du droit ne tenait plus tout à fait debout et perdait de sa pertinence, au point que certains aient proposé un nouveau paradigme pour la construction architecturale du droit : le réseau. L’auteur interroge ces déplacements avec l’émergence de la médiation judiciaire au Québec et sa potentielle transformation de la fonction de juger.
