Abstract
L’examen critique du droit de l’application des peines au Canada indique que ce droit est fragmenté entre diverses sources juridiques qui définissent et sanctionnent des écarts de conduite en prison. La gestion de l’inconduite se fait selon une procédure appropriée devant des tribunaux disciplinaires présidés tantôt par le directeur de l’établissement pour les infractions mineures tantôt par un professionnel venu de l’extérieur pour les infractions graves. Selon la jurisprudence canadienne, le détenu inculpé devant les instances disciplinaires ne peut pas invoquer toutes les garanties juridiques prévues dans la Charte canadienne des droits et libertés dans le cadre d’un procès pénal.
