Abstract
A Suprema Corte do Canadá está em vias de julgar o pedido de reparação civil decorrente da prisão, estupro e morte de Zahra Kazemi, sob custódia da República Islâmica do Irã, em 2003. As instâncias anteriores da justiça canadense decidiram pela manutenção da imunidade de jurisdição do Estado iraniano mesmo diante das alegações de violação de jus cogens e de incidência de uma das exceções à imunidade de jurisdição previstas no Canada State Immunity Act. O julgamento ilustra a tendência atual de manutenção da prerrogativa de imunidade de jurisdição dos Estados em matéria civil, mesmo diante da prática de tortura.
