Le nombre de 300 000 enfants combattants est une estimation annuelle conservatrice avancée par les experts du milieu pour susciter un plus large consensus international sur l’urgence d’intervenir. Ce nombre demeure constant depuis le milieu des années 1990 et cache en réalité un chiffre beaucoup plus alarmant : celui incluant la succession de générations d’enfants combattants. Quelles sont donc les failles d’un système international qui permet encore en 2006 que l’enfance continue d’être massacrée ? À partir du traitement des sources documentaires et de notre expérience terrain des 15 dernières années dans le secteur de l’aide humanitaire, nous posons comme principe dans cet article que puisque l’enfant est désormais considéré comme un sujet de droit, tel que consacré par la Convention internationale relative aux droits de l’enfant, les adultes responsables de sa protection (parents, communautés nationale et internationale) ont failli à leur tâche. Nous avançons de même que les outils du droit international dans leur forme actuelle et étudiés ici, et malgré des efforts notables d’amélioration, présentent toujours de sérieuses lacunes et demeurent insuffisants en ce qui concerne la protection des enfants afin d’éviter qu’ils ne deviennent des acteurs dans les conflits armés.
