Abstract
En manifestant publiquement sa réprobation à l’égard de son employeur, que ce soit sous forme de dénonciation ou de critique, un salarié exerce sa liberté d’expression, liberté fondamentale garantie par les chartes des droits. Pourtant, lorsqu’ils ont à juger du caractère abusif ou non d’une telle conduite, les tribunaux se replient généralement sur les concepts traditionnels du droit civil que sont la « faute » et l’« obligation de loyauté ». Ainsi, la plupart du temps, la prise de parole du salarié est assimilée à un manquement à ses obligations contractuelles. Dans le texte qui suit, les auteurs rappellent que ce devoir de loyauté relève, somme toute, du droit « ordinaire », alors que les assises de la liberté d’expression sont, elles, de nature constitutionnelle. Ils plaident pour un plus grand respect de la hiérarchie des normes et, par conséquent, en faveur de la reconnaissance d’un espace critique accru en milieu de travail.
