Abstract
Résumé Nous discutons de l’apport de l’analyse économique du droit pour l’étude des procédures judiciaires, en ce qui concerne notamment le débat entre systèmes inquisitoire et accusatoire et le rôle du juge dans le cours de la procédure. L’article commence par une présentation de la littérature avant de s’intéresser à la matière pénale puis au contentieux civile. Dans les deux cas, la démonstration est apportée que le rôle du juge est susceptible d’être déterminant dans la recherche de l’efficacité du système judiciaire. De ce fait, cet article prend le contre-pied de nombreuses analyses antérieures qui concluent généralement à la supériorité – en termes d’efficacité économique – du système de Common Law caractérisé par un rôle plutôt passif du juge.
