Résumé Le processus d’embauche de la plupart des entreprises implique une période d’essai, c’est-à-dire un laps de temps au cours duquel l’employeur observe le salarié, vérifie sa qualification et son aptitude à remplir le poste qui lui est confié, tandis que le salarié découvre son nouveau travail et juge s’il lui convient. Dans les faits, c’est plutôt l’employeur qui décide de poursuivre ou de rompre la relation d’emploi en exerçant son droit de direction. Si ce droit est quasi absolu, il ne s’exerce pas sans contrainte juridique. Cet article vise à décrire l’état du droit sur ces obligations tant dans les milieux non syndiqués que dans les milieux syndiqués au Québec. D’abord, nous traitons de la liberté des parties quant à l’établissement d’une période d’essai, en ce qui concerne sa durée, la formation à offrir, son renouvellement et son extension. Ensuite, nous présentons les deux grandes responsabilités des employeurs à l’égard de la gestion des employés à l’essai, soit les initier au travail de manière loyale et convenable et les évaluer de bonne foi de façon non discriminatoire, sans arbitraire, ni abus. Puis, nous expliquons les droits que possèdent les salariés à la fin de la période d’essai. Finalement, nous examinons les motifs justifiant la rupture du lien d’emploi de l’employé à l’essai.
