La recherche en science sociale qui se penche sur les réalités des communautés francophones en situation minoritaire du Canada emploie fréquemment les concepts d’autonomie, de gouvernance et d’institutions, sans cependant leur donner un fondement juridique dans le cadre constitutionnel canadien. Le présent texte tente justement d’explorer cette question, en cherchant d’abord à définir un concept de droit à des institutions autonomes de la minorité, pour voir ensuite si un tel droit repose sur des bases juridiques. Sont explorées l’autonomie territoriale puis sectorielle, dans les domaines de l’éducation, de la santé, des municipalités et des ententes entre le gouvernement fédéral et les associations communautaires. S’il existe un droit à des institutions, il demeure en émergence dans bien des secteurs et se confine pour l’instant à la sphère administrative.
