Abstract
Les transferts de fonds internationaux par virements bancaires utilisent des réseaux spécialisés de télécommunications. Chacun de ces réseaux a adopté des règles internes de fonctionnement. Mais ces règles sont loin d'être uniformes et d'englober tous les aspects des rapports juridiques entre les parties. Par ailleurs, peu de pays ont légiféré dans ce domaine. Lorsqu'il s'agit de transferts internationaux, les décisions des tribunaux risquent d'être contradictoires. Il en résulte beaucoup d'incertitude juridique. Afin d'harmoniser les règles juridiques dans les transferts de fonds internationaux par virements bancaires, le Comité des Nations Unies pour les contrats commerciaux élabore présentement un projet de loi type. Celui-ci tient compte de l'article 4A du Uniform Commercial Code récemment adopté par plusieurs États américains. Les principaux aspects de ce projet de loi type sont ici soulignés.
