Abstract
Le projet de loi sur la société de l’information, présenté en Conseil des ministres le 13 juin dernier, comporte un chapitre relatif à l’« accès aux données publiques » qui a pour principal objectif d’aménager l’accès et l’exploitation de l’ensemble des données produites par un organisme public ou privé chargé d’une mission de service public. Le projet de loi propose à ce titre une définition des “données essentielles“ dont la diffusion tant auprès du public que des opérateurs souhaitant les exploiter sera gratuite, tandis que la diffusion des autre données pourra donner lieu à la perception d’une redevance par l’organisme public producteur. Mais plus encore, le projet de LSI pose l’épineuse question du droit d’auteur des fonctionnaires, actuellement étudiées par le Conseil supérieur de la propriété littéraire et artistique.
