Abstract
Le régime québécois d'assurance automobile indemnise toutes les victimes de préjudice corporel sans égard à la responsabilité de quiconque, et ce, même lorsqu 'il s'agit de comportement criminel au volant. La victime « innocente » et le conducteur fautif ont un même droit aux indemnités prévues et sont tous deux à l'abri des recours de droit commun. D'aucuns estiment qu'il y a là une injustice qui doit être corrigée en traitant ces accidents non plus comme des cas relevant de la Loi sur l'assurance automobile, mais plutôt comme des cas relevant de la Loi sur l'indemnisation des victimes d'actes criminels. Au-delà du débat quant au bien-fondé de telles critiques, l'auteur analyse l'incidence d'un comportement criminel sur l'application des principaux régimes québécois d'indemnisation des victimes d'un préjudice corporel et fait état des difficultés que poserait le rattachement des cas de comportement criminel au volant à la Loi sur l'indemnisation des victimes d'actes criminels.
