Abstract
L’auteur présente la réforme que vient d’adopter le législateur québécois dans un domaine hautement sensible, celui de la place de la religion à l’école publique et notamment l’enseignement religieux. La société québécoise, après avoir accepté un amendement à la Constitution qui a supprimé en 1997 les privilèges confessionnels détenus par les catholiques et les protestants s’est orientée vers une confessionnalité progressive de son système scolaire. La réforme a été précédée d’un Rapport désormais célèbre, le Rapport Proulx, qui préconisait la laïcisation intégrale du système. L’auteur critique ce Rapport comme véhiculant une conception discutable de la laïcité. Il critique les fondements jurisprudentiels sur lesquels s’appuient les auteurs de ce Rapport. Il présente ensuite la solution adoptée par l’Assemblée nationale du Québec dans la Loi 118 du 16 juin 2000, relative à la confessionnalité. Celle-ci se veut un compromis entre les valeurs découlant des Chartes des droits et des textes internationaux, d’une part, et les droits historiques des communautés catholique et protestante du Québec, d’autre part, dans un contexte que l’auteur qualifie de laïcité ouverte ou positive.
