Abstract
Le régime provincial de protection de la jeunesse tend à marginaliser les conceptions autochtones de la famille, qui sont souvent fondées sur le rôle de la famille élargie et des formes d’adoption coutumières propres à chaque communauté. En effet, les intervenants sociaux et les tribunaux prennent généralement des décisions en se fondant sur leurs propres références culturelles, ce qui les conduit à méconnaître les conceptions autochtones de la famille. Les directives données par le législateur de tenir compte de la culture autochtone ont eu peu d’effet pratique. Seule l’autonomie gouvernementale des peuples autochtones en matière de protection de la jeunesse paraît pouvoir changer la donne.
