Abstract
L’évolution du droit des risques littoraux fait apparaître que ce dernier a émergé dans un contexte marqué essentiellement par l’absence de stratégie. Le droit répond au coup par coup à la réalisation des divers risques. Ce d’autant que la prise en considération spécifique des risques littoraux eux-mêmes n’apparaît que dans la période la plus récente. Nous sommes bien dans la production d’un droit sans stratégie. Celle-ci va constituer une nécessité face à l’occurrence du risque marqué cette fois par un aléa relatif et ses conséquences. Il en résulte que l’intégration de cet aléa relatif dans la prévention des risques va conduire à produire un droit des risques littoraux en appui d’une stratégie et d’un droit adapté en conséquence. Cependant si le contexte est réellement en mutation sous l’impact du droit européen, sa portée reste encore limitée. L’affirmation d’un cadre d’intervention renouvelé paraît dès lors une nécessité.
