Abstract
Le droit des cours d’eau en France est particulièrement complexe, comme d’ailleurs l’ensemble du droit de l’eau. Il n’existe pas de régime juridique unique des cours d’eau, le droit français distinguant les cours d’eau domaniaux et les cours d’eau non domaniaux, chacun de ces types de cours d’eau disposant d’un régime juridique spécifique. Le droit de propriété des cours d’eau en France se partage entre personnes publiques (État, collectivités territoriales) et personnes privées, une différenciation étant opérée entre le lit et les berges ; l’eau elle-même étant chose commune. Les droits d’usage, quant à eux, posent parfois des problèmes très aigus, essentiellement dans le cas des cours d’eau non domaniaux, mais, globalement, l’interventionnisme étatique semble de plus en plus marquer le droit français des cours d’eau.
