Abstract
Le prêt de main-d’oeuvre à titre exclusif et à but lucratif est interdit en France. Les formes légales de mise à disposition de personnel et notamment le travail temporaire sont donc strictement encadrées. Leur utilisation fait l’objet d’un contrôle administratif et judiciaire strict. Ces formes de mise à disposition coexistent avec d’autres mécanismes rassemblés sous le vocable général de « sous-traitance ». Au sens strict, la sous-traitance consiste pour une entreprise à confier à une autre l’exécution partielle d’une tâche qui lui incombe. Au sens large, elle inclut la « sous-traitance » interne par laquelle une entreprise demande à une entreprise extérieure de réaliser des tâches sur son site. Dans tous les cas, ces techniques parfois appelées « d’externalisation » ont pour effet de faire coexister spatialement des travailleurs appartenant à des entreprises différentes. Cette coexistence augmente les risques d’accident dans un contexte où l’identification du « décideur » s’avère parfois difficile. Les prévenir suppose de tenir compte de la pluralité d’entreprises concernées et de chaînes de direction.
