Le projet de loi C-56, devenu C-13, piloté par la ministre de la Santé depuis le 9 mai 2002 concerne les techniques de procréation assistée et la recherche connexe. Il donne suite dans une large mesure aux recommandations de la Commission royale sur les nouvelles techniques de reproduction (commission Baird), dont la version définitive date de 1993. Le projet de loi C-13 a toutefois été conçu comme une mesure se fondant sur la compétence criminelle du Parlement fédéral. Selon l’auteur, plusieurs des dispositions du projet de loi C-13 qui concernent les « activités réglementées », contrairement à celles qui portent sur les « actes interdits », ne peuvent se justifier à titre de mesures criminelles. En particulier, le projet de loi C-13 s’ingère dans les activités ordinaires des cliniques et des laboratoires de fertilité sans poursuivre à cet égard l’objectif de réprimer un « mal » véritable. La jurisprudence de la Cour suprême de la dernière décennie portant sur la compétence criminelle ne permet pas d’aller aussi loin.
