Prenant appui sur une recherche empirique qualitative, l’article montre la façon dont les acteurs judiciaires se représentent l’apport des « droits de la personne » dans le processus de prise de décisions et dans l’évolution de la justice pénale. La démarche s’inscrit dans une approche sociologique du droit qui privilégie une mise en relation des points de vue interne et externe au droit dans la production de connaissances. Méthodologiquement, l’analyse repose sur des entretiens réalisés auprès de juges et de procureurs de la couronne au Canada et au Portugal. L’analyse de ces données a permis d’identifier quatre contributions attribuées aux droits de la personne dans la prise de décisions : ils protègent les personnes accusées, ils permettent le contrôle de la validité des normes, ils stimulent l’évolution des principes du droit et enfin, ils facilitent l’adaptation du système à la société ou à son environnement. Encadrés d’un point de vue théorique par certains outils empruntés aux travaux de Niklas Luhmann et de Gunther Teubner, les résultats présentés permettent de mieux observer et comprendre la place et le rôle qu’occupent les « droits de la personne » dans la prise de décision judiciaire moderne, leurs contributions et aussi leurs limites.
