Le principe de participation du public se reflète dans plusieurs règles du droit international. Cet article soulignera la place des individus et des communautés dans trois pans du droit international, à savoir le droit des cours d’eau internationaux, le droit international de l’environnement et le droit des droits de l’homme. Chacune de ces trois typologies de normes apporte des caractéristiques particulières au principe de la participation du public dans la gestion des ressources en eau transfrontières. Le droit des cours d’eau internationaux indique que la transmission d’informations sur la qualité des eaux doit faire partie des régimes sur les cours d’eau internationaux. Le droit international de l’environnement met l’accent sur la participation du public dans le processus d’étude d’impact environnemental (EIE), en soulignant ainsi qu’une approche de prévention doit être adoptée afin de prévenir la survenance d’un dommage à un cours d’eau international. Enfin, le droit international des droits de l’homme consacre l’intérêt public de la gestion des ressources en eau et donne aux individus et communautés un titre juridique à recevoir des informations et à être consultés dans la gestion des ressources en eau.
