Les infections nosocomiales sont un des plus graves problèmes auxquels fait face la médecine moderne et revêtent une ampleur qui leur a valu de faire récemment l’objet d’une attention médiatique et sociale accrue au Québec. Bien qu’il soit habituellement aisé de relier l’apparition de l’infection à l’acte ou au milieu médical, il est souvent impossible de déterminer la cause de cette infection. Cette incertitude empêche par la suite de déterminer si une faute est à l’origine de la contraction de l’infection. La victime d’une infection nosocomiale fait donc face à la lourde tâche de prouver la cause probable de son préjudice et de démontrer si celle-ci peut être reliée à une faute du médecin, du personnel hospitalier ou de l’hôpital. L’augmentation du nombre de victimes d’une infection contractée en milieu hospitalier met donc au défi la structure, les éléments constitutifs, et même le champ d’application des règles traditionnelles de la responsabilité civile élaborées pour satisfaire aux cas classiques de responsabilité. Dans le texte qui suit, l’auteure s’intéresse au contentieux de l’infection nosocomiale au Québec et en France et étudie de quelle façon la jurisprudence de ces ressorts répond aux difficultés soulevées par la question de l’indemnisation des victimes d’une infection nosocomiale.
